Terms of Use

These Terms of Use ("Terms") form a binding agreement between you ("you", "user") and Miru Movies ("we", "us", "our"), the provider of the Miru Movies mobile application and backend (the "Service") — which helps people discover and match on movies to watch together.

By installing, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required to use an online service in your country, if higher) to use Miru Movies. By using the Service you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of another person (such as a family member), you confirm you have their permission to do so.

2. Your Account

You may use Miru Movies with an anonymous device-scoped account or by signing in via a supported identity provider (e.g. Firebase Authentication). You are responsible for:

• The accuracy of the information associated with your account.
• All activity that occurs under your account.
• Safeguarding your device and any credentials used to sign in.

Notify us promptly at [email protected] if you believe your account has been compromised.

3. Licence to Use the Service

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install, and use the Service for your own personal, non-commercial purposes.

4. Acceptable Use

When using Miru Movies, you agree not to:

• Use the Service for any unlawful, harmful, fraudulent, or abusive purpose.
• Harass, threaten, impersonate, or harm other users (including partners you link with).
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Service, except to the extent permitted by applicable law.
• Use automated means (bots, scrapers, crawlers) to access the Service, or bypass rate limits or technical restrictions.
• Interfere with or disrupt the integrity, performance, or security of the Service or related infrastructure.
• Resell, redistribute, or commercially exploit the Service or any content obtained through it.
• Use the Service to transmit viruses, malware, or other malicious code.

We may suspend or terminate accounts that violate these rules.

5. User-Submitted Content

The Service allows you to submit limited content such as profile preferences and feedback. You retain ownership of what you submit. However, by submitting content to us you grant us a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, and use that content solely to operate, improve, and support the Service.

You represent that any content you submit is your own or that you have the rights to submit it, and that it does not violate these Terms or applicable law.

6. Movie Data and AI-Generated Content

Movie metadata (titles, posters, cast, release dates, ratings, etc.) is provided by third parties, including TMDB and OMDB, and is subject to their respective terms. The "hype" narratives shown for movies are generated by an artificial intelligence model (Google Gemini) and may contain inaccuracies, creative embellishments, or unexpected outputs. They are provided for entertainment only and should not be relied upon as factual plot summaries, reviews, or endorsements.

7. Intellectual Property

The Service, including its design, code, logos, the "Miru" name, and all non-third-party content, is owned by Miru Movies and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership to you other than the limited licence granted in Section 3.

8. Third-Party Services

The Service relies on third parties, including Google Firebase, Google Cloud, Google Gemini, TMDB, and OMDB. Your use of features powered by these providers may also be subject to their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.

9. Availability and Changes to the Service

We strive to keep the Service running reliably, but we may modify, suspend, or discontinue any feature (or the Service as a whole) at any time, with or without notice. We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of harmful components.

10. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.

11. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Miru Movies be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Service — even if advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed, in the aggregate, the greater of (a) the amount you have paid us to use the Service in the twelve months preceding the claim, or (b) USD 20.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for gross negligence, wilful misconduct, or statutory consumer rights).

12. Indemnification

You agree to indemnify, defend, and hold harmless Miru Movies from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party right, including any intellectual property or privacy right.

13. Termination

You may stop using the Service at any time. You may also delete your account and associated data at any time — see our Data Deletion page for instructions.

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive termination (including Sections 5–12 and 15) will continue to apply.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Effective date" above and, where appropriate, notify you in the app. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws applicable at the developer's place of residence, without regard to its conflict-of-law principles. Mandatory consumer protection laws in your country of residence still apply where required.

Before initiating any formal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at [email protected]. We will try in good faith to resolve the issue within 30 days.

16. Miscellaneous

• Entire agreement: these Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
• Severability: if any provision is held unenforceable, the remaining provisions remain in full force.
• No waiver: our failure to enforce any right or provision is not a waiver of that right.
• Assignment: you may not assign these Terms without our prior written consent; we may assign them freely.
